TERMS AND CONDITIONS OF THE FLAT HOUSES " ELIZJUM "
Ladies and Gentlemen!
We would like to welcome you to the Apartment Cottages Resort " ELIZJUM ". We hope that with the help of the following rules and regulations we will be able to ensure your full satisfaction with your holiday in our resort, and at the same time ensure its efficient organisation.
To ensure that your stay is pleasant and enjoyable, we kindly ask you to familiarise yourself with and observe the following rules:
1.Rental of ELIZJUM Apartment Cottages is at least weekly. The possibility of booking shorter periods only exists by individual arrangement by telephone or e-mail, subject to availability.
Each booking is subject to a deposit payment in the amount of 30-40 % of the entire stay. The deposit must be paid into an account within 2-5 days after booking. Payment of the deposit is tantamount to acceptance of the booking conditions and terms and conditions.
Failure to pay the deposit within the indicated period is tantamount to cancellation of the booking unless the hirer, after subsequent payment, obtains confirmation of its retention by the Owner.
Please write in the title of the transfer: "Deposit for cottage, number of persons X,Name"
Transfers with the title "Advance payment for the cottage, number of persons X,Name" will be returned, with a view to correcting the title formula to the correct one.
The deposit is non-refundable regardless of whether the depositor uses the cottages.
The rest of the price for the stay can be paid by bank transfer 3 days before arrival or in cash on the day of arrival at the latest. In the case of a bank transfer, a written confirmation must be presented on the day of arrival. We do not accept credit card payments.
The Lessee shall specify the number of persons entitled to use the cottage when making a reservation. In the event of exceeding the declared number of persons using the house (without the consent and knowledge of the Lessor), the Lessor reserves the right to charge the Lessee an additional fee for non-contractual use of the house in the amount of 80 % of the set residence fee for each excess person.
9.The price for the stay does not include the local tax of 3.30 PLN/person/day, determined by the Resolution of the Mielno Municipality. The local tax is collected in cash on arrival. The contract concluded between the parties covers only the possibility to use the cottages and their equipment. It does not cover any other issues, including transportation, catering or organisation of the time of stay.
A service charge is added to the price of the stay: electricity and wateraccording to consumption: water: PLN 0.05/l, electricity: PLN 2.00/kWh. Settlement is on the day of departure.
Service charge in the amount of PLN 200 for the entire stay, amount to be collected on arrival, one time. Payment to be made on site, in cash only.
Cancellation of part of the stay or late arrival does not entitle to a refund of the entire booked stay.
The facility reserves the right to change the cottage number.
Check-in time is from h. 16:00 on the day of arrival until 10:00 the following day. Accommodation is provided between 16.00 a 18.00, a de-accommodation from 8.30 a.m. to 10.00 a.m.. If it is not possible to arrive or depart at the indicated times, the Hirer is obliged to notify the Lessor by telephone in advance. Failure to check in by 18:00 without prior telephone notice and consent of the owner will result in cancellation of the booking, no deposit refunded.
Please notify the owners at least 24 hours before your departure if you end your stay earlier than 9:00. If you do not agree with the owners in advance, staying in the cottage or on the premises of the Resort after 10:00 a.m. (on the day of departure) entitles the owner to charge the Guests for the next day, not guaranteeing the possibility of prolonging the stay.
The handover of the cottage and the handing over of the keys takes place in the presence of the staff of the resort, after the payment for the period covered by the reservation has been made. Upon arrival, but before moving in, the Lessee is obliged to collect the cottage, i.e. to check the condition of the furniture, windows and other equipment in the cottage, as well as its sanitary and hygienic condition. The absence of any remarks during this period shall be deemed to be a statement that the cottage has been handed over without any objections to the condition (including the condition of the appliances).
Guests are charged a damage deposit in the amount of 400 PLNwhich must be paid upon arrival. The deposit is fully refundable provided no damage has been caused to the property during your stay.
A handover report shall be drawn up when the Lessee leaves the cottage, including the status of the meters (electricity and water). Leaving the facility without handing it over to the Landlord entitles the Landlord to draw up a unilateral protocol of the condition of the rented bungalow.
Guests are given a key for the cottage they have rented. If the keys are lost, a flat-rate reimbursement of the cost of replacing the locks shall be made. PLN 300.00.
Only accommodated persons are entitled to use the Apartment Cottages. A photo ID must be presented at check-in.
It is forbidden for third parties to stay on the premises. Any unaccommodated person staying on the Elysium premises without the owner's permission will be immediately charged PLN 100. It is strictly forbidden for third parties to stay after 22:00.
Playground and recreation area only for guests staying in the accommodation.
Curfew hours are 22:00-06:00. Visitors to the resort must not disturb other holidaymakers. The resort closes at midnight (this applies to the entrance gate). It is forbidden for non-residents to stay in the Centre during the curfew (10 p.m. to 6 a.m.), at other times only with the consent of the owners.
The Guests are obliged to observe these Rules and Regulations and, moreover, regulations concerning safety and fire protection, principles of good neighbourhood and to behave in a manner that does not threaten the safety of others. Violation of any of the provisions of these Regulations may constitute grounds for refusal to conclude or immediate termination of the house rental agreement without the right to reimbursement of the amounts paid to the Lessor. The Lessee shall bear full responsibility on a risk basis for persons accompanying him/her and persons invited by him/her or persons accompanying him/her during his/her stay. The misconduct of these persons shall be treated as misconduct of the Tenant. In particular, the landlord reserves the right to refuse to accommodate persons or to de-accommodate them without being entitled to a refund of the price of the persons:
under the visible influence of alcohol or drugs,
who behave aggressively, in a manner commonly regarded as vulgar.
Smoking is strictly prohibited in the cottages (smokers are welcome in the fresh air). Violation of this prohibition is punishable by a fine of PLN 1,000.00, added to the tenant's bill.
It is forbidden to repair or upgrade the equipment in the cottages yourself.

Parking is unguarded, for an additional fee. The owner guarantees 1 parking space per cottage. Additional parking spaces - paid - number of spaces limited. Failure to declare an additional parking space at the time of booking may result in no spaces available.
The owner of the resort is not materially responsible for the belongings of guests left in the cottage or on the premises of the resort, nor is he legally or materially responsible for damage or theft of cars left in the car park of the resort (unguarded car park). The obligation to protect their belongings against theft and damage rests with their owners.
The owner of the Resort is not responsible for any valuables and cash left in the cottages or rooms, so please take due care to lock the windows and doors when leaving the cottage or room.
The owner of the Resort is not responsible for any inconvenience caused by reasons beyond his control, e.g. power or water cuts or lack of TV or Internet signal, etc.
Parents or guardians are solely responsible for the safety of children on the premises. It is forbidden to leave children unattended, especially on the playground.
It is forbidden to clean and fry fish in the cottages. Failure to comply with this ban will result in a charge to the guests in the amount of
£1,000 for hiring a specialised company to ozone the cottage.
Pets (dogs and cats) are allowed in the facility. only after notification and approval at the time of booking. This information is necessary as the number of cottages designated for stays with animals is limited. Arriving with a dog or cat without prior arrangement may result in accommodation in a cottage not intended for stays with animals, which will result in a higher pet fee of 100 PLN/day or 150 PLN/day (over 10 kg). . - Maximum of 1 dog in the house/no exceptions.
Pet stays notified at time of booking - for an additional charge of 30 PLN/day/up to 10 kg or 50 PLN/day/above 10 kg. - Maximum of 1 dog in the cottage/ without exception.
Pet owners are required to have a current vaccination booklet, clean up waste and walk their pets outside the premises. Dogs must be kept on a leash and muzzled only. Pet owners are fully responsible for their animals. Pets are strictly forbidden in the playground area - failure to comply with this rule entitles the facility owner to charge the pet owner in the amount of
PLN (amount taken from the deposit).
Guests are required to separate their rubbish. All waste from cottages should only be placed in containers located in designated areas on the Site. Failure to comply with the waste segregation rules will result in a penalty of double the final cleaning amount per cottage - taken from the deposit.
Fire safety rules must be observed. The use of open flames (including candles, paraffin lamps, gas lamps, your own electric and gas cookers) is prohibited in the cottage. Open fires must not be left unattended, electric heating appliances or other appliances that may cause a fire hazard must not be used. GRILLING is only possible in designated areas. All safety and fire precautions must be observed when barbecuing. It is strictly forbidden to barbecue in cabins or to use pyrotechnics, lanterns, firecrackers etc., Failure to comply with this ban will result in a fine of PLN 200.
The Lessee may not sublet the cottage or use it on any other legal basis to third parties, even if the period for which he has paid the fee due for the stay has not expired.

These Rules of Procedure are made available on the following website www.elizjum-domki.pl and is available in the cottage. The hirer is obliged to inform all persons accompanying him of its contents.
In matters not covered by these Terms and Conditions, the provisions of the Civil Code and the Act on Tourist Services shall apply accordingly.
NOTE !!!
In accordance with the current wording of the VAT Act (Section XI, Articles 106-112c), the wish to receive a VAT invoice for legal persons (companies) must be expressly stated at the time of booking (no later than upon payment of the deposit). The wish to receive an invoice for the remaining amount of the stay must be notified before making the payment (transfer min. 3 working days before arrival or payment in cash on arrival). Otherwise, it will not be possible to issue such an invoice.
